Cancellation Policy

Cycling.Tours accepts bookings, subject to the following conditions:

To secure a booking a booking form on behalf of the party accepting the terms of these booking conditions is to be completed together with a non-refundable deposit of 20% to secure the booking. If making a booking within 60 days of your arrival date the total cost of the holiday must be paid in full.

The balance of the booking must be paid 60 days before your arrival date. Cycling.tours will forward an invoice with all payment details at the time of booking. If the balance is not paid by the due date, then we reserve the right to cancel your holiday and apply any necessary cancellation and administration charges.

Cycling.Tours reserves the right to amend or cancel any arrangements as they see necessary should the situation arise. In all cases, we will inform you at the earliest opportunity of any changes that have been made.
By taking part in any holiday organised by Cycling.tours it is at your own risk and neither Cycling.tours nor any employee of Cycling.tours are responsible or liable for any injury, loss or death.

Cycling.tours will not be liable for any death, illness, injury, damage, loss, accident or delay which may be caused by any defect in a vehicle, hire bike or through the acts and/or omissions of any company or person, in carrying out the arrangements of the holiday.
If a hire bike is damaged or stolen whilst in your care, you will be liable for the cost of repair or replacement of the bike. This cost will be determined by the hire company and Cycling.tours will pass this cost directly to you for settlement. Settlement of the costs to the hire company must be made before departure.
If you want to cancel your holiday, it must be confirmed in writing immediately and will be subject to the cancellation charges listed below: –
If the cancellation is received more than 60 days prior to arrival – a cancellation fee of 25% of the total holiday cost, unless rescheduled for an alternative holiday date is due.
If the cancellation is received 60 – 40 days prior to arrival – 50% of the total holiday cost, unless rescheduled for an alternative holiday date is due.
If the cancellation is received less than 40 days prior to arrival – 100% of the total holiday cost, unless rescheduled for an alternative holiday date is due.

It is the sole responsibility of each cyclist to ensure they have a travel insurance policy in place before they depart, and that it covers road cycling as an activity. A copy of your insurance will be requested upon arrival.
Photographs, likenesses or images of participants secured or taken on any of our holidays may be used by Cycling.tours without remuneration in all media for bona fide promotional or marketing purposes.

Cycling.tours is not liable or responsible for any loss/theft or damage to property, equipment or belongings at any time. However, during your stay, we will make every effort to keep you and your property safe.

Cycling.tours will not be held responsible for amendments or cancellations made to holidays due to war, threat of war, riots, civil strife, industrial disputes, terrorist activity, natural or nuclear disasters, fire, technical problems to transport, closure of ports or airports, airline strikes, adverse weather conditions or any other circumstances.

COVID-19 cancellations
If you are not able to travel due to closed boarders or imposed travel restrictions caused by the COVID pandemic, then we will transfer your deposit, or move your holiday to a future date that has availability, within the season you have booked. If no availability is suitable in the season you have booked, your deposit or balance will be transferred to the following season. You will be subject to any price increase as we cannot hold prices into the following season. If your holiday was discounted due to a group or discounted booking and your new booking is not part of a group or discounted offer, then your payment will go towards the cost of your new booking and you will be responsible for the increased payment within 60 days of your holiday date. If your new holiday is moved to a reduce premium week, you will receive a refund for the over payment. If borders are closed due to anything other than COVID pandemic, you must still adhere to our cancellation policy.
If you choose not to travel due to COVID for personal choice, are shielding or do not wish to take the needed requirements to travel, such as COVID tests, which means you are then not allowed to enter the country that your Cycle Retreats holiday is being held in, then we are NOT liable to re-arrange your holiday, or return the non-refundable deposit/payments and the cancellation policy as outlined above in Cancellation Policy and Charges applies.

Terms & Conditions

 

IMPORTANT. These Terms and Conditions cover all events purely organised by Cycling.tours Events. Please read them carefully prior to registering for the event. You should only register and enter the event if you have read, understood and agreed with these conditions.

 

These conditions represent a legally binding agreement between you and Functional Fitness Events. If you have any questions about these terms please contact cycling.tours.

 

  1. General

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts. These conditions constitute the entire agreement and supercede any previous agreement between you and the organiser. You acknowledge by completing the entry form you cannot rely on any statement or representation or assurance however made by any person other than as laid out in this agreement. If any of these conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these conditions, shall be enforced to the fullest extent allowed by law as to the effect the intentions of the parties, and shall not affect the validity of any remaining conditions. The terms and conditions do not affect your statutory rights. These terms were last updated Jan 2021.

 

2.Limit of Liability

The Organiser shall not be liable for any loss, death, injury or damage however caused to any person or property, except where such loss, death, injury or damage is a result of the negligent acts or omissions of the organiser. Any claim to which legal liability is established shall not include damages for indirect or consequential loss.

 

  1. Conditions of Entry

The minimum age for our events is 17 years as of the 31st December 2020. You acknowledge that participation in our events involves the real risk of serious injury or death from various causes including exertion, strenuous activity, equipment failure, dehydration, collisions, or incidents involving other competitors, spectators or other road users, aspects of the course or bad weather conditions. The event will be physically demanding and you are aware of the associated medical and physical risks involved. You accept that you are physically capable of competing in the event and agree that, subject to the limitation of liability paragraph below, cycling.tours, its officers, agents, affiliates, sponsors or medical advisers are not responsible for any injury or illness that you may suffer as a result of your participation in the event. The entrant accepts that should any medical or physical condition arise prior to the event which is likely to affect their ability to compete then the entrant will withdraw in accordance with these terms and conditions. It is the entrant’s responsibility to ensure that their equipment including bike is roadworthy and helmet complies with the British Cycling England rules and regulations. The organiser reserves the right to disqualify or remove the entrant from the event for general misconduct, dangerous racing or other unreasonable behaviour. Should the entrant be disqualified or removed there will be no entitlement to a fee refund or an entry credit. You will inform us on the reverse of your race number of any medical conditions from which you suffer. You give permission to our event staff and medical support to make decisions regarding your medical care and treatment and, where necessary, to authorise such care and treatment in emergency situations. You understand that our event staff will make every reasonable effort to reach your emergency medical contact you have supplied, however you hereby give permission to the medical professional whose services might be required to provide medical care and treatment.

 

Unless otherwise specified by the organiser and subject to temperature readings on the day, swimming wetsuits are compulsory for any open water swim participation. It is the entrant’s responsibility to provide a wetsuit. Entrants / attendees without a wetsuit will not be allowed to compete / participate. Shortie wetsuits are allowed but not recommended since they are not as buoyant as a swimming wetsuit. Surfing wetsuits will be very tiring on the swim as they are not as flexible as a swimming wetsuit. You further acknowledge and understand that compulsory insurance effected for the event may not cover you for any or any injury, loss or damage sustained by you. You are strongly advised to obtain personal accident and personal items coverage, adequate for the event.

 

  1. Confirmation of Entry

When you register for a Cycling.tours Event you will receive a confirmation email within 24hours. If you do not receive this email please get in touch with us via the contact form on the website and we will chase this up for you.

 

  1. Pre Event Information

All necessary information for the event will be published on the event web site. Updated details of any alterations to race information will be made available on the web no later than 7 days prior to the event. It is the responsibility of the entrant to ensure they have accessed the relevant information online. No information will be sent through the post. It is your responsibility to ensure you have provided us with a valid e-mail to prevent important e-mails going to junk.

 

  1. Withdrawal or Cancellations

All entries are electronic. There is a 10 day cooling off period after placing your order when a full (a small deduction will be taken as an administration fee) refund is possible if you contact cycling.tours on our website form.

This cooling off period no longer applies in the month leading up to the event. You may withdraw from the event at any time, subject to the provisions of this clause.

Cancellation of an event 8 week prior to the event 50% refund.

Cancellation of an event 4 weeks prior to the event 25% refund.

Cancellation of an event less than 4 weeks from the day of the event no refund.

 

All cancellations can be deferred to the next years equivalent event if 1 months notice is given before the day of the event. There is a 10% admin charge for all deferrals. You cannot defer a deferred entry.

All refunds are based on the entry fee that you paid and not the current entry price.

 

  1. Place Changes

Event entrants cannot transfer their place with that of another athlete. This is due to insurance issues and any athlete found to have transferred their entry will be disqualified and banned from any future cycling.tours Event.

 

  1. Event Changes

We reserve the right to change the format of the event or cancel the event. We will only exercise these rights due to events beyond our control and in the event of the event being changes you will receive a 25% Discount for any future cycling.tours Event. One example of such a change could be if extreme weather means that the distance or duration of the event is reduced significantly for safety reasons in which case the event would change. Should we require to change the date of the event, you will have 14 days to notify us of your withdrawal from the event and receive a refund but thereafter will be held to the above terms set out in point 6. Should we have to cancel the event we will offer you a place at one of our other events. No refunds will be issued at any event on the day.

 

  1. Publicity & Results

You irrevocably consent to your appearance being filmed, recorded on any media of whatever nature, and consent to your name, appearance, photograph being used for the purposes of promoting the event and to the commercial rights relating to the event. We reserve the right to change these terms and conditions. You also give permission to cycling.tours Events & Coaching and their business partners delivering the event to use your email address for the purpose of marketing and promoting our future events. We will never share your email address or personal information with third party companies that are not providing a service in operating the events.

 

  1. Insurance

Cycling.tours are fully insured with both public and private liability cover. However individual athletes are strongly recommended to take out their own insurance which covers them to take part in sporting activities of this nature.

 

  1. Right to Refusal of Entry

Cycling.tours maintain the right to refuse or revoke entry to any applicant, where they believe that accepting the entry could prejudice the event, the promoting organisation their sponsors, associates or staff. This right of refusal extends to include applications where acceptance is considered by the promoters to be likely to infringe upon the enjoyment of any persons connected with the event, including staff, marshals, volunteers & other competitors.
